1. INTRODUCTION

1.1. These Terms and Conditions regulate all purchases, which include the registration, placing orders and accessing ALCINO Silversmith products, through the website www.alcino.com.
1.2. The website www.alcino.com is managed by the company Manuel Alcino & Filhos Lda, with VAT number: 501613919 and Activity Title nr. T10106 (Main Activity: Silversmith Retailer – Distance Selling Communication Means), based at Rua de Santos Pousada, 76, 4000-478, Porto, Portugal.
1.3. For the purposes of these Terms and Conditions is understood by:
a) – “ALCINO Silversmith” – The products marketed by ALCINO Silversmith through the website www.alcino.com;
b) – “User” – Any individual who places an order through the website www.alcino.com;
1.4. The use of the website www.alcino.com and the purchase of products ALCINO Silversmith presumes knowledge, understanding and acceptance of these Terms and Conditions by the User.

2. REGISTRATION ON THE WEBSITE

2.1. To place an order, the User can register by filling in the mandatory fields of the registration form on the website www.alcino.com.
2.2. After completing the registration, the User has access to their personal account, where they can manage the account settings, and check the status of their orders.
2.3. From the moment the User access their personal account, the User is subjected to these Terms and Conditions.

3. PRODUCTS ALCINO SILVERSMITH

3.1. The website www.alcino.com is directed at all users who want to purchase products ALCINO Silversmith from their home or workplace, 24 hours a day, 7 days a week.
3.2. All information on product characteristics of the products can be found at www.alcino.com.
3.3. ALCINO Silversmith reserves the right to modify, at any time the information, the range of products, prices, promotions and the existing terms and conditions presented on the website www.alcino.com.

4. PLACING ORDERS ON THE WEBSITE

4.1. To place na order on the website www.alcino.com is necessary that the User has an email account and that their browser is set to accept cookies and pop-ups, which will allow the full use of all the available features on ALCINO Silversmith’s online store.
4.1.1. The User may proceed with the online purchase of products, and to do so it’s necessary to:
a) Find the product (s) you wish to purchase;
b) Add the selected product (s) to the “Shopping Cart”;
c) Register the User’s personal data, which includes “Delivery Address”, “Billing Address”, “Payment Method”, telephone number and tax identification number (VAT) if applicable;
d) Review your order and it;
4.2. The User will receive na email confirming the order with the details of the selected payment method. After we receive validation of the payment, the User will also receive an email confirmation. After we receive validation of the payment, the User will also receive an email confirmation.
4.3. ALCINO Silversmith will provide all the details of the purchase through the website www.alcino.com, on the User’s cliente area.
4.4. Your order will be delivered by the logistics operator at the delivery address provided in the purchase process as well as the corresponding detailed invoice.
4.5. By submitting the order form the User agrees to these Terms and Conditions described at www.alcino.com.
4.6. ALCINO Silversmith reserves the right to refuse and cancel orders already confirmed, in the following situations:
a) The product is not available;
b) The payment is not carried out by using any of the payment methods specified on the website www.alcino.com;
c) The payment cannot be confirmed;
d) The billing information is not correct or verifiable;
e) There is an error in the price quotation;
f) It is not possible to deliver the order at the delivery address provided by the User.

5. PRICES

5.1. The prices of products displayed on the website www.alcino.com include Value Added Tax (VAT). The total VAT payable by the User will be indicated on the invoice to be sent to the user.
5.2. All prices are quoted in Euros (€). Note that changing the delivery country may influence the prices due to different shipping costs. The customs costs may also be applicable in certain countries and will be paid by the User.
5.3. Prices of products displayed on the website are subject to change. ALCINO Silversmith reserves the right to change prices without prior notice. The prices displayed at the time of purchase are the prices applicable to that purchase.
5.4. The total price specified in the checkout includes the taxes from the country of origin (Portugal) and shipping costs.
5.5. The User must only pay the amount specified in the order confirmation.

6. PAYMENT METHODS

6.1. The User may pay for their purchases through Paypal, through Multibanco Reference, MBWay, Credit Card (Visa, Mastercard, Maestro) and Wire Transfer.

6.2. ALCINO Silversmith will not accept any payment method other than those mentioned in the previous point. The User should not try to pay by any other means which are not included in the specified payment methods. If you do so, we cannot be held responsible for loss of payment or any other damages that may occur.

7. SHIPPING COSTS

7.1. Shipments to Portugal (Mainland) start at €6,50 and go up to €16,00 depending on the weight of the item(s) and respective packaging, between 1Kg and 30Kg.
7.2. Shipments to Portugal Islands (Açores and Madeira) can vary between €10,00 and €28,00 depending on the weight of the item(s) and respective packaging, between 1Kg and 30Kg.
7.3 Shipments to Spain (Mainland) can vary between €9,00 and €36,00 depending on the weight of the item(s) and respective packaging, between 1Kg and 30Kg.
7.4 Shipments to Spain (Islands) can vary between €18,00 and €36,00 depending on the weight of the item(s) and respective packaging, between 1Kg and 30Kg.
7.5. Shipments to specific European countries – France, Germany, Italy, Netherlands, Belgium and Luxembourg can vary between €16,00 and €46,00, depending on the weight of the item(s) and respective packages, between 1Kg and 30Kg.
7.6. Shipments to the rest of the World are subject to a quotation and will be subsequently informed by email. The payment of Customs taxes associated with the destination country is of the customer’s sole responsibility.

8. DELIVERY

8.1. Delivery of orders is processed by CTT Expresso, or another carrier contracted by ALCINO Silversmith (DPD, NACEX, INVICTADADOS, MRW, among others). ALCINO Silversmith shall send the product(s) ordered by the User, from Monday to Friday, from 9am to 6pm, except on holidays, and according to the days and times used by the logistics companies, to the delivery address provided by the User. In case the User presents an address within the postal codes of the city of Porto (between 4000-000 and 4369-999) and chooses the delivery method at home, ALCINO Silversmith guarantees the delivery of the ordered product(s), unless stock is out, on the same day, if the order is placed and paid by 12:00 on the same day, or on the following day, if the order has been placed or paid after 12:00.
8.2. Our delivery service does not include scheduling options, so the delivery of the order will be carried out without prior notice from the carrier, thus being necessary to ensure that someone is at the delivery address to receive the order.
8.3. Delivery times may vary depending on the stock availability. The responsiveness of ALCINO Silversmith within the deadlines is, however, dependente on the availability of stock and cannot be guaranteed in periods of promotions, campaigns and special seasons.
8.4. At the time of delivery, the User must inspect the package in order to check for possible damage. If the User finds that the products are damaged, you should not accept the delivery of the order, which will be returned. he User shall report the situation, if possible document it with photos to the e-mail: online.store@alcino.com and if the User agrees, ALCINO Silversmith will proceed to resend the order at no cost to the User. If the User wishes to cancel the order, the full paid amount will be reimbursed.
8.5. If you do not receive your order within 90 (ninety) days from the order payment date, please send us an email to: online.store@alcino.com, informing us of the situation.
After this period, ALCINO Silversmith can not be held responsible for the loss of the order.
8.6. ALCINO Silversmith considers the delivery done with the signature on the delivery receipt at the agreed delivery address.

9. THE RIGHT TO FREE RESOLUTION

9.1. The User may return orders up to 14 (fourteen) days after receiving them, provided that:
a) The product(s) have not been used;
b) The product(s) mantain their original features;
c) The product (s) are complete. All material accompanying the orders must be returned to ALCINO Silversmith.
9.2. Once the returned items are received, ALCINO Silversmith will review and confirm its condition and, when applicable, will refund the User the total amount paid within a maximum of 10 (ten) days.
9.3. If the returned products are damaged or worn, ALCINO Silversmith reserves the right not to accept the return and refuse to refund the User.
9.4. The right of free resolution shall not apply to the manifestly customized product(s).
9.5. The User should note that if the return has been made for reasons other than the existence of justified defects or nonconformity of the ordered products, ALCINO Silversmith will not make the reimbursement of the shipping costs. Therefore, ALCINO Silversmith will not reimburse the cost of delivery initially supported by the customer for the respective order.

10. CANCELLATIONS AND RETURNS

10.1. The User is not allowed to cancel an order already placed. Before submitting the order, the User must review all the details of the order to avoid errors and possible complications.
10.2. The User can not cancel or exchange orders that contain customized items according to their specifications.
10.3. ALCINO Silversmith does not support exchange costs. The User may exchange the order for another one as long as it is available on the website, and will have to pay all costs related to the exchange.
10.4. In the event that the ordered product is found to be defective or other non-compliance, the User may choose to:
a) repair the product;
b) replace the product;
c) resolve the contract.
10.5. Once the User notices a defect or other nonconformity of the product, these have to be communicated to the email: online.store@alcino.com, having photos as proof.
10.6. Once we receive your email, we will contact you to resolve the issue in a consensual way.
10.7. In any of the options exercised by the User, stated in the point 10.6, the respective costs will always be supported by ALCINO Silversmith.

11. QUALITY

ALCINO Silversmith will make every effort so that the colors of the products that appear on the website www.alcino.com are the most accurate and real as possible. However, since computer monitors vary, we cannot guarantee that your monitor will be showing the exact colors.

12. WARRANTY AND AFTER SALE ASSISTANCE

ALCINO Silversmith products benefit from the warranty in accordance with the legislation applicable to the sale of consumer goods.

13. EXCLUSION AND LIMITATION OF LIABILITY

ALCINO Silversmith does not guarantee that the website www.alcino.com will run uninterruptedly, or any of its features, as it may be suspended for carrying out maintenance work, repairs or upgrades.
ALCINO Silversmith will also not assume any liability for any damages arising directly or indirectly from force majeure situations that prevent ALCINO Silversmith is, in any way, to meet its obligations, in particular, strikes, electric network failures, telecommunication services or any other services faults, fires, floods, inability to obtain products, materials or services, breakdowns, delays of carriers and changes in laws or administrative regulations. ALCINO Silversmith is not responsible for any misuse of the User’s access data to the website by third parties, as these are personal and non-transferable.

14. MODIFICATION OF TERMS AND CONDITIONS

ALCINO Silversmtih reserves the right to change, at any time, these Terms and Conditions, considering the changes made and users notified by publication on the website www.alcino.com of the modified Terms and Conditions.

15. TREATMENT OF PERSONAL DATA

16. EVIDENCE

The eletronic records, kept by ALCINO Silversmith in security conditions, are considered as proof of communications, orders and payments made between ALCINO Silversmith and the User.

The present Terms and Conditions and all disputes arising that are related to them, including its validity, the use of the website or any purchase made on it, shall be governed by Portuguese Law.
